近日,最高人民检察院发布检察技术支持刑事检察技术性证据审查典型案例。其中,披露了这起 " 李某甲故意杀人案 " 办案细节。2016 年 4 月,犯罪嫌疑人李某甲离婚,其子李某乙(2012 年 5 月 23 日出生)一直随祖父李某丙生活。2020 年起,李某甲与其子单独生活。从 2022 年 10 月开始,李某甲阻止李某乙上学和外出,并拒绝他人与李某乙见面。2023 年 4 月 26 日,李某乙被发现死于家中,公安机关以涉嫌过失致人死亡罪对李某甲立案侦查。李某甲否认犯罪,其辩护人提出李某乙可能存在自身疾病或潜在性疾病,其死亡结果不能完全归责于李某甲。对于鉴定意见等证据专门审查 重构被害人死因链条李某乙初次死因鉴定意见认定其符合饮食不规律、长期营养不良引起重度肝脂肪变性伴点状坏死,导致肝功能障碍、衰竭和急性坏疽性胆囊炎而死亡。经山东省、市、县三级检察技术部门法医联合审查发现以下问题:原鉴定意见认定死者患有急性坏疽性胆囊炎并作为死因之一,但未提取胆囊进行病理检验,仅凭胆囊颜色改变认定急性坏疽性胆囊炎,认定依据不足;尸体检验不到位,部分判定营养不良的检验项目未进行;死者体表 10 余处新旧皮下出血的损伤,未论证其在死因中作用;死者饮食不规律的推定,缺乏严谨性。为厘清上述问题,检察技术部门启动重新鉴定,最终认定李某乙死因系长期营养不良致重度肝脂肪变性,引发多器官功能衰竭死亡,其体表损伤新旧程度不一,且胆囊无病变。该意见重构了被害人的死因链条,揭示了被害人生前曾经历长期虐待的客观事实。锁定 " 明知垂危 " 的主观故意等 关键证据案发后,李某甲主动向侦查人员反映手机损坏,侦查人员用技术手段恢复其手机,发现里面内容已删除。检察技术人员恢复了被删除数据,发现李某甲在案发前两日及当日均拨打过一名火化车司机电话。该司机证实李某甲曾当面称 " 家中有人快去世,需预约火化车辆 ",案发当天又两次拨打其电话称 " 人已去世,下午用车 "。时间节点与被害人死亡进程高度吻合,证实李某甲主观上明知被害人处于生命垂危的状态。还原 " 阻止施救 " 案件事实侦查过程中,侦查人员获得数段于案发前一天傍晚李某丙到李某甲家探望的公共视频。但因公共视频探头不能拍摄到屋内情况,且声音极为模糊,故一直未被作为重要证据。检察技术人员对音视频进行清晰化和降噪处理,复原了大部分对话内容。证实李某甲因怀疑李某乙非亲生,拒绝李某丙探望,称 " 李某乙已两月未进食、无法行走,就要饿死李某乙 "。当李某丙提出接走李某乙时,李某甲称 " 一拳打死李某乙 "。该证据还原了李某甲阻止施救行为并希望或放任被害人死亡的主观故意。检察机关通过多种技术手段辅助认定李某甲作为李某乙的监护人,明知其生命垂危拒不救助且阻止他人施救,导致李某乙死亡,构成故意杀人罪。2024 年 7 月 13 日,被告人李某甲因犯故意杀人罪,被法院判处无期徒刑,剥夺政治权利终身。来源 |  最高人民检察院、南方 · 都市报 、中国新闻社
